Rajiv Ruparelia, the Ruparelia Group Managing Director has, through his lawyers, demanded that DFCU bank apologises to him for breach of confidentiality.
This follows a widely circulated memo, released last week by DFCU bank lawyers accusing Rajiv of propagating fake news about the bank or risk legal action.
In a notice written last Friday, the bank’s lawyers, Kalenge, Bwanika, Ssawa and Company Advocates also demanded for a public apology from Mr Rajiv.
Less than a week after, Rajiv’s lawyers, Walusimbi and Company Advocates have come out to demand that publications expressed as a Notice of Legal Action dated October 5 be retracted and an apology issued for ‘splashing’ Rajiv’s mobile number all over social media and thus breaching confidentiality.
“Our client’s attention has been drawn to various social media publication through your agents M/S Kalenge, Bwanika, Sawa & Co. Advocates clearly expressing themselves to be acting on your instructions wherein they to his regret and enormous inconvenience published and widely circulated among others his phone number – a detail otherwise given to you in confidence tied to his account held with yourselves by virtue of having succeeded the same from the Crane Bank Limited (in receivership),” advocate Nelson Walusimbi writes in the notice of regal action, received by DFCU lawyers on October 8, 2018.
“Our client begrudges the breach of confidence actionable both civilly and criminally and accordingly requires an immediate formal apology similarly shared on all platforms hitherto published to, together with atonement for the same ail not later than close of business this week.”
Rajiv’s lawyers sign off by demanding that all correspondences regarding the said subject be addressed through their chambers.
“Expect no further warning,” advocate Walusimbi writes.
