The Court of Appeal has nullified the election of Democratic Party (DP)’s Wakayima Musoke as Nansana Municipality MP on grounds that he isn’t a registered voter.
On July 20, 2016, Justice Vincent Okwanga of the High Court said the name Wakayima Musoke Nsereko which he used for his nomination for the seat does not appear in the voters’ register of Nansana Municipality but rather the name Musoke Hannington Nsereko which validly appears on his national identification card thus nullifying his election.
The Judge then declared NRM’s Robert Kasule Ssebunya, who had become second in the elections, as the area MP.
However, Seven days after being thrown out of parliament Wakayima filed a notice of appeal challenging the ruling.
Today’s Court of Appeal ruling means that Kasule will now replace Wakayima in parliament without going through a by-election.
