Court of Appeal has upheld High Court’s decision of nullifying Forum for Democratic Change (FDC)’s Apollo Kantinti’s election thus ruling against him in an election appeal of Kyadondo Parliamentary seat.
The justices ruled that after a careful re-evaluation of the evidence on record, they have also come to a conclusion that it was not clear on who won the Kyadondo East constituency election since results from 9 polling stations were not included in the final tally.
In July last year, High Court Judge Isabirye Kaweesa nullified Kantinti’s election on grounds of non-compliance with several electoral guidelines under the Parliamentary Elections Act by the Electoral Commission.
NRM’s William Sitenda Sebalu sued Kantinti, the Electoral Commission and Wakiso district Returning Officer Sarah Bukirwa for conniving to commit several irregularities which affected the quality of the election in Kyadondo East in a substantial manner.
Kaweesa found Bukirwa guilty of disenfranchising voters and failing to secure custody of election materials when she refused to account for the whereabouts of declaration forms from seven polling stations in the constituency.
Justice Kaweesa also faulted Bukirwa for failing to file a police report in relation to the seven polling stations whose results she unfairly and unilaterally cancelled.
